2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into a contract to place an order.

By submitting a photograph, name, personalisation detail or other material relating to another person, including a child, you confirm that:

• You are authorised to provide the material
• You are authorised to request the artwork
• The requested use does not unlawfully infringe another person’s rights
• The material is not unlawful, abusive, exploitative or harmful

3. Products and Availability

BAMBBENO offers personalised artwork that may be supplied as digital content or as an available printed product.

Product formats may include digital artwork, posters, framed posters, canvas products and framed canvas products.

Product availability, subject limits, formats, sizes, prices, currencies, production capacity and eligible delivery destinations may change.

The product page, selected options, checkout and order confirmation are authoritative for the individual order.

4. Product Images and Mock-ups

Website photographs, room displays, frame mock-ups and product previews are illustrative.

Screen settings, crop, materials, printing equipment, paper, canvas texture and framing processes may cause reasonable differences between a website image and the physical item.

The confirmed product type, size, format, finish and approved artwork govern the order.

5. Orders and Contract Formation

Submitting an order is an offer to purchase the selected product.

A contract is formed when BAMBBENO accepts the order, confirms payment or begins the requested work, unless we tell you that the order cannot be accepted.

We may decline, suspend or cancel an order where:

• Payment or required information is incomplete
• The submitted photograph is unsuitable
• The request cannot be completed safely or lawfully
• The request infringes or may infringe another person’s rights
• There is an obvious pricing or availability error
• The requested product cannot reasonably be produced or delivered
• The customer engages in fraud, abuse or threatening conduct

If BAMBBENO cancels an accepted order after payment and no alternative is agreed, the affected amount will be refunded.

6. Customer Information and Photographs

You are responsible for providing accurate order details, contact information, delivery information, photographs and creative instructions.

Photographs should be sufficiently clear for the requested artwork. BAMBBENO may request a replacement photograph or additional information.

We are not responsible for limitations directly caused by blurry, cropped, obstructed, heavily filtered, compressed or low-resolution source material where those limitations were reasonably explained or visible.

7. Personalisation, Proofs and Revisions

Personalised artwork involves creative interpretation. The finished work may not be an exact photographic reproduction unless the chosen style specifically requires that result.

Where a proof is provided, you must review all visible details carefully before approval.

Reasonable revisions within the original order direction may be provided according to the product description and communication sent for the order.

A new photograph, new subject, different style, different product, different format or substantially different composition may require an additional payment or new order.

Approval authorises BAMBBENO to proceed with final digital delivery or physical production.

8. Customer Content Licence

You retain ownership of original photographs and other original material you submit.

You grant BAMBBENO and the providers reasonably needed to fulfil the order a limited, non-exclusive licence to receive, store, review, edit, combine, reproduce and use the submitted material only as reasonably necessary to:

• Assess and process the order
• Create and revise the personalised artwork
• Prepare a proof
• Produce and deliver the selected product
• Provide customer support
• Correct an error or production problem
• Comply with legal, fraud-prevention or security obligations

This order licence does not give BAMBBENO permission to publish customer content in public marketing. Public marketing use requires separate permission.

9. BAMBBENO Intellectual Property

BAMBBENO and its licensors retain rights in the website, brand, logo, designs, templates, layouts, creative systems, product presentation and other underlying assets.

Unless BAMBBENO agrees otherwise in writing, purchase of a portrait provides a limited licence to use the delivered artwork for private, personal and non-commercial purposes.

You may print a purchased digital file for personal use. You may not, without written permission:

• Resell or commercially distribute the artwork
• License the artwork to another business
• Use the artwork for commercial merchandise
• Claim ownership of BAMBBENO’s underlying templates or design systems
• Remove ownership or rights notices where included

10. Prices, Payment and Taxes

Prices and currencies are displayed on the product page and during checkout.

Applicable tax, delivery charges and discounts are shown where relevant before payment.

Payment is processed through the payment methods made available through Shopify checkout.

BAMBBENO may correct an obvious pricing, currency or availability error before accepting the order.

11. Cancellation and Returns

Cancellation, order changes, personalised product restrictions, damage claims, replacements and refunds are governed by the Return, Cancellation and Refund Policy.

The standard customer cancellation-request window is 15 minutes from order placement, provided creative work or production has not started.

Nothing in these Terms removes consumer rights that cannot lawfully be excluded.

12. Delivery

Digital and physical delivery is governed by the Shipping and Digital Delivery Policy.

Production and delivery dates are estimates unless BAMBBENO expressly confirms a guaranteed date in writing.

13. Acceptable Website Use

You must not:

• Use the website for unlawful, fraudulent or abusive purposes
• Submit unlawful, exploitative, infringing or harmful material
• Attempt unauthorised access to accounts, systems or customer information
• Introduce malware, harmful code or automated attacks
• Interfere with website, checkout or security functions
• Scrape or copy the website in a harmful or commercially exploitative manner
• Impersonate another person or misrepresent authority to use a photograph

BAMBBENO may restrict access or refuse service where reasonably necessary to protect customers, the website, legal rights or security.

14. Third-Party Services and Links

The store may use or link to third-party services, including payment, production, delivery, analytics or social media providers.

Third-party services may be governed by their own terms and privacy information. BAMBBENO is not responsible for an independent third party’s website or service except where applicable law provides otherwise.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or mandatory consumer rights.

Subject to applicable law, BAMBBENO is not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

16. Changes to These Terms

BAMBBENO may update these Terms for future website use and future orders.

The version applying when an existing order was accepted continues to govern that order unless a change is required by law or agreed with the customer.

17. Governing Law

These Terms are governed by the laws of England and Wales.

Consumers retain mandatory protections and access to courts available under the laws of their country of residence.
